Terms of Service
These terms define the rules of engagement between you and Social Drishti. We've written them in plain language so you know exactly where you stand. Last updated 01 January 2024.
By accessing or using socialdrishti.com or engaging our services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services. These terms apply to all visitors, clients, and anyone else who accesses our website or engages with Social Drishti.
Social Drishti offers digital marketing, branding, content strategy, and related creative services. The scope of any engagement is defined in a separate Statement of Work or project agreement. We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice. We make no warranties that our services will be uninterrupted or error-free.
Upon full payment, clients receive ownership of final deliverables specifically created for them under a project agreement. Social Drishti retains ownership of all underlying tools, frameworks, methodologies, and pre-existing intellectual property used in producing work. We reserve the right to display completed work in our portfolio unless otherwise agreed in writing.
You agree to provide accurate, complete, and timely information necessary for us to perform our services. You are responsible for ensuring that any materials, content, or assets you supply do not infringe third-party intellectual property rights. Delays caused by late approvals, missing assets, or unclear feedback may affect timelines and costs, which remain your responsibility.
Payment terms are specified in individual project agreements. Invoices are due within the timeframe stated therein. Late payments may accrue interest at 1.5% per month or the maximum rate permitted by law, whichever is lower. We do not offer refunds for work completed or in progress unless there has been a material breach of agreement on our part.
To the fullest extent permitted by law, Social Drishti shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services. Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim in the three months preceding the event.
Both parties agree to keep confidential any proprietary or sensitive information shared during an engagement. This obligation survives the termination of any agreement. We will not disclose your business data, strategies, or materials to third parties without your written consent, except as required by law or to deliver the agreed services.
Either party may terminate a project agreement with 14 days written notice. On termination, you are responsible for payment of all work completed up to the termination date. Social Drishti reserves the right to immediately suspend services in the event of non-payment, breach of these terms, or conduct detrimental to our team or reputation.
These Terms of Service are governed by and construed in accordance with the laws of India. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra. If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
